Behavior Rules Governing the Use of the West Orange Public Library

The Behavior Rules of the West Orange Public Library (the “Library”) have a threefold purpose: to protect the rights and safety of Library patrons, to protect the rights and safety of staff members, and to preserve and protect the Library’s materials, facilities, and property. These Behavior Rules apply to all persons entering on Library property, including the Library building and all grounds controlled or operated by the Library.

 

Prohibited Conduct

1.1 Except at otherwise noted, the following conduct is prohibited inside the Library building and on all grounds controlled or operated by the Library:

A. Committing or attempting to commit any activity that would constitute a violation of any federal, state, or local criminal statute or ordinance including, but not limited to, the following:

(i) Engaging in sexual conduct prohibited under federal, state, or local law;

(ii) Committing or attempting to commit any act of violence; and

(iii) Possessing, selling, distributing, or ingesting any controlled substance.

1.2 Being under the influence of alcohol or any controlled substance.

1.3 Possessing, selling, distributing or consuming any alcoholic beverage.

1.4 Carrying a gun, knife, or any other weapon, device, instrument, material or substance, whether animate or inanimate, which may be used to produce death or serious bodily injury.

1.5 Using electronic equipment such as pagers, stereos, televisions, and cellular telephones at a volume that disturbs others or engaging in loud or boisterous physical behavior or talking.

1.6 Using any Library material, equipment, furniture, fixture, or any other Library property (hereinafter collectively referred to as “Library property”) in a manner inconsistent with its customary use or in a manner likely to cause damage to Library property or in a manner likely to cause personal injury.

1.7 Theft of or vandalism to WOPL property, or the personal property of library patrons or staff.

1.8 Smoking in the Library building.

1.9 Eating or drinking in the Library building except in areas designated by the Library for that purpose.

1.10 Bringing bicycles, skateboards, or similar equipment inside the Library building.

1.11 Bringing animals inside the Library building, with the exception of service animals.

1.12 Disobeying the reasonable direction of a Library staff member.

1.13 Soliciting, petitioning, canvassing for political, charitable, or any other purpose inside the Library building, including the doorway or vestibule, or in a manner on Library premises that unreasonably interferes with traffic or impedes access to the Library building.

1.14 Using Library restrooms for bathing, shaving, washing hair, and changing clothes.

1.15 Sleeping in or on Library premises.

1.16 Leaving a child under age eight unattended anywhere on Library premises.

1.17 Entering the Library with bare feet or a bare chest.

1.18 Using abusive or threatening language or gestures toward Library staff or patrons.

1.19 Harassing a Library staff member on account of that individual’s sex, race, color, religion or creed, gender, sexual or affectional orientation, marital or family status, pregnancy, age, ancestry or national origin, military service, and disability or handicap.

1.20 Emitting strong, pervasive odors, including odors caused by perfume or cologne that unreasonably interfere with the library user or staff comfort, safety, use, or peaceful enjoyment of the library.

1.21 Depositing bodily fluids on Library property, including library collections, equipment, and furnishings.

1.22 Oversized Bags - The West Orange Public Library limits the amount and size of carts, suitcases, bags, packages and other personal property. A maximum of two bags of any type are allowed. All oversized carts, suitcases, bags, packages and other personal property may not occupy floor space in excess of 9″ x 14”x 22″ (approximate TSA size). Items must fit the aforementioned dimensions.  All items are subject to inspection.

 

Violations of Behavior Rules

2.1. Violation of any of these behavior rules may result in ejection from the Library, with or without warning, in the discretion of Library staff.

2.2. Violation of any of these behavior rules may result in the loss or suspension of Library privileges for a period of up to three years.

2.3 Except in cases in which the continued presence of a patron threatens the safety of another individual, damage to Library property, or disruption of Library operations, the Library will notify patrons of a potential suspension or loss of Library privileges either by personally serving the patron with written notice or by mailing notice by certified mail, return receipt requested to the patron’s last known address. The written notice will set forth the reasons for the Library’s proposed action, the length of the proposed suspension, and the process for challenging the proposed suspension under paragraph 2.4.

2.4 Challenging Proposed Suspensions Under Paragraph 2.3. Within five business days of the receipt of notice that the Library is intending to suspend the patron’s Library privileges, the patron may challenge that action by writing to the Library’s Board of Trustees. The patron should set forth all reasons why the patron believes that the Library’s contemplated action is unwarranted. The Board will issue a written decision determining the matter within ten business days of its receipt of the written challenge.

2.5 In cases in which the Library suspends privileges immediately such as when a patron’s continued presence threatens the safety of another individual, damage to Library property or disruption of Library operations or in cases of partial suspension of privileges such as when the Library has suspended borrowing privileges, the privilege to use the Library computers, or the privilege to use the Library meeting room under its Schedule of Fines, Fees, and Charges on Overdue, Lost, or Damaged Materials, and Internet and Meeting Room Policies, respectively, the Library will notify patrons of the suspension of Library privileges either by personally serving the patron with written notice or by mailing notice by certified mail, return receipt requested to the patron’s last known address. The written notice will set forth the reasons for the Library’s action, the length of the suspension, and the process for appealing the suspension under paragraph 2.6.

2.6 Appeal of Suspensions Under Paragraph 2.5. Within five business days of the receipt of notice that the Library has suspended the patron’s Library privileges pursuant to paragraph 2.5, the patron may appeal that action by writing to the Library’s Board of Trustees. The patron should set forth all reasons why the patron believes that the Library’s action is unwarranted. The Board will issue a written decision determining the matter within ten business days of its receipt of the appeal.

2.7 A patron who has damaged, through inappropriate or unauthorized use, books, magazines, e-book readers, or audio-visual materials will be liable for the replacement cost of such items as set forth in the Library’s Schedule of Fines, Fees, and Charges on Overdue, Lost, or Damaged Materials. A patron who has damaged, through inappropriate or unauthorized use, any other Library property will be liable for the cost incurred by the Library to repair the damage. If the damage is not repairable, the patron will be liable for the cost incurred by the Library to replace the damaged property.

Bulletin Board Policy

1.1 In the interest of advancing its mission of making available to the West Orange community the broadest range of material concerning matters of education, recreational, and cultural interest, the West Orange Public Library ("the Library"), subject to the conditions set forth below, offers free, open, and equal access to its bulletin board.

1.2 In permitting use of its bulletin board for public notices, the Library gives first priority to the notices issued by the Library, followed by notices issued by other West Orange Township public agencies. When the bulletin board is not needed for these purposes, the Library gives priority to notices announcing programs or events sponsored by West Orange organizations.

1.3 All notices posted on the bulletin board, other than notices issued by the Library or another West Orange Township public agency, shall publicize programs or events open to the public.

1.4 The Library will not post notices related to the following activities:

(a) commercial activities or presentations during which products or services will be sold or promoted or names solicited for the future sale or promotion of products or services; and

(b) recruitment of personnel or enrollees by any branch of the armed forces, by any educational institution, or by any other entity.

1.5 The Library will not accept handwritten notices or notices on paper that is ripped or torn.

1.6 The Library will not accept notices on paper that is larger than 8 1/2 x 17.

1.7 The Library will post notices submitted by nonpublic organizations for up to one week.

1.8 All notices must set forth the name of the sponsoring organization and provide the name and telephone number of an individual whom interested parties can contact.

1.9 Organizations seeking to post notices on the bulletin board must bring a copy of the notice to the Administration Office. The Library Director will permit posting of notices on a first-come, first-served basis and in accordance with the priorities established in paragraph 1.2 above. The Library Director will not permit posting of notices if there is insufficient space or if the notice conflicts with the rules and restrictions set forth in this policy.

1.10 The Library will discard notices posted without authorization.

1.11 Except for notices issued by the Library, posting of a notice on the bulletin board does not imply sponsorship or endorsement by the Library.

 


Collection Policies; Material Selection And Access

1. The West Orange Public Library endorses the Library Bill of Rights and its interpretations, the Freedom to Read, the People’s Rights to Libraries, and the Freedom to View.  These are included as part of this policy. 

2. This policy refers to all books (rental or free), pamphlets, audio and video, electronic resources and other materials that are part of the Library’s collection. 

3. The criteria used for the selection of materials apply equally to both purchased and gift items. 

4. The final authority for the determination of policy in the acquisition of materials is vested in the Library Board of Trustees. 

5. Responsibility for the selection of materials within this policy and the control of expenditures rests with the Library Director and qualified staff delegated by the Library Director, within the constraints of the budget. 

6. Criteria for selection of materials include: 

  • Quality of the materials as a whole.
  • Permanent or timely value of the subject matter.
  • Educational, informational, or recreational value of the subject matter.
  • Authority and accuracy of the matter presented.
  • Author’s reputation and significance as a writer.
  • Relation of item to the rest of the collection.
  • Significant needs of the Library’s patrons and of the community.
  • Reputation of the publisher or producer.
  • Format.  
  • Price.
  • Opinions of others as expressed in such professionally approved sources as the  Fiction Catalog, the Public Library Catalog, and the Children’s Catalog; reviewing media such as Kirkus’ Service, Publishers’ Weekly, Library Journal, Booklist, etc.; and various lists published by the American Library Association, educational associations, and other libraries. 

7. Textbooks shall not be considered for purchase unless they fill a special need in the collection or are the best work available on a given subject. 

8. Electronic Media: The Library provides customers with access to the Internet and other electronic resources and supports the American Library Association's doctrine on Access to Electronic Information, Services, and Networks. The Internet is a global electronic network that provides dynamic resources and facilitates communication. Because Library staff cannot control access points that often change rapidly and unpredictably, customers are responsible for the choice of sites accessed.(See West Orange Public Library Policy on Internet Use)  

9. The Library will strive to provide a representative selection of materials on all subjects of interest to its public.  The Library will not purchase materials produced solely to trade on a taste for sensationalism or which are purely pornographic in Policy 2022 update.doc linda7/6/2022 S:\Supervisors\BoardDocs\Material Selectionintent.  However, serious, well-written or produced works which present an honest aspect of life shall not be excluded because of their frankness of language or because the situation may be offensive to some readers or viewers, or because they may not be suitable for all age levels. 

10. A patron’s request for purchase of a specific item will be given consideration.  If an item meets the criteria for purchase, an effort will be made to purchase it and the patron will be notified of its purchase.  If purchase is not possible, the Library will try to get the item for the patron from another library. 

11. The same criteria will be applied to the purchase of children’s materials. 

12. Accessing Physical materials outside of West Orange Public Library: BCCLS: The library is a member of BCCLS, a library consortium in four counties with 77 members and a shared catalog of over six million items all freely available to West Orange Public Library cardholders.   REBL: The library participates in REBL which is an agreement to provide reciprocal borrowing between most of the public and academic libraries in Essex County.  A REBL sticker on your library card provides access to participating libraries.  The REBL sticker will be provided at the circulation desk for West Orange cardholders in good standing. Inter-library loan (ILL): The library is able to access materials from other institutions across New Jersey, the United States and around the World.  Most materials available in New Jersey are found in JerseyCat and delivered free of charge throughout the state.  WorldCat provides access to materials across the United States and the World.  These materials typically require a cost, which is the responsibility of the patron. 

13. Library materials which have been chosen according to the criteria of selection will not be removed from the Library’s collection solely at the request of any individual or group.  The Library recognizes that censorship is a purely personal matter and declares that while all individuals are free to reject materials of which they do not approve, they cannot exercise the right of censorship to restrict the freedom of others to read or view.  The Library does not accept responsibility to oversee or monitor the reading or viewing of materials by any age group. 

14. If a patron wishes materials to be reconsidered for removal from the Library’s collection, a form is available for the patrons to complete.  No reconsideration of materials will be considered without this completed form.  When a request for removal of Library materials is received, the materials involved shall remain available for circulation while the matter is being resolved.  Matters of removal of Library materials will be decided by the Director. The Director will only consider requests for reconsideration from West Orange residents. Anyone disputing the decision may then bring the matter before the Library Board of Trustees. 

15. The Library will oppose coercion on the part of any individual or group seeking to add materials to the collection which are not acceptable according to the Library’s selection criteria.  A form is available and must be completed by the patron for reconsideration for purchase or acceptance as a gift any material previously considered unacceptable for purchase.  This matter will be decided by the Director Policy 2022 update.doc linda7/6/2022 S:\Supervisors\BoardDocs\Material Selectionand anyone disputing this decision may then bring the matter before the Library Board of Trustees. 

 


Exhibit Policy

Having considered the limited exhibit space within the Library, and having determined that exhibits related to the themes of Library programs is a priority, the West Orange Public Library (the "Library") adopts the following policy governing the use of its exhibit space.

1.1 Except as otherwise stated below, the exhibit cases of the Library are reserved exclusively for exhibits sponsored by the Library and are not open to the public.

1.2 The Library will consider both local and non-local artwork in creating its exhibits and will retain a file of photographs of artwork submitted to it for future review. The Library is under no obligation to choose artwork from the file of retained photographs. In formulating its exhibits, the Library will also consider sources outside of the file of retained photographs.

1.3 On an annual basis, the Library will cosponsor an exhibit of student artwork with the West Orange Board of Education.

 


Internet Use Policy

Access to Internet Resources

1.1 Subject to the conditions set forth below, the West Orange Public Library (the "Library") is committed to providing free, open, and equal access to the Internet. This policy furthers the Library's mission of offering the broadest range of material to West Orange's diverse community. It is consistent with the principles of intellectual freedom expressed in the American Library Association's Library Bill of Rights, which the Library endorses and follows.

1.2 The Internet is an unregulated medium. It offers access to material that may be personally, professionally, and culturally enriching. It also offers access to material that may be inaccurate, incomplete, untimely, illegal, and, in the view of some users, offensive to themselves or inappropriate for their children. The Library does not monitor and has no control over the information accessed through the Internet and is not responsible for its content. Under 47 U.S.C. section 230, the Library shall not be treated as the publisher of any information on the Internet provided by another party.

1.3 The Library's main Webpage, along with its Web pages for children and teens, is accessible at www.westorangelibrary.org. The Library's Web pages list recommended links to additional Websites so that users may more easily locate material suited to their particular ages or their particular interests. The Library is not responsible for the content of linked sites or for the content of sites accessed through subsequent links.

 

In Library Access

2.1 The Library affirms the right of each individual to have access to constitutionally protected material allowable in a public space. The Library also affirms the right and responsibility of parents and legal guardians of minor children to determine and monitor their own children's use of Library materials and resources.

2.2 Parents or guardians who wish to limit or restrict the access of their own children should personally oversee their children's use of the Internet.   The Library does not monitor or supervise the use of computers by minors.  The Library does not act in loco parentis; it does not take the place of parents or guardians in deciding what children may read or view. Parents and children are encouraged to read "Child Safety on the Information Highway," available at http://www.safekids.com; a link to this publication also appears on the Library's Children's Webpage.

2.3 As set forth in paragraphs 3.5 and 3.10 below, the Library supports users' right to privacy. The Library's workstations, however, cannot be made completely private or completely secure. Current technology cannot guarantee perfect security; users should be aware that electronic communications and files may become public. Users, moreover, should be mindful that the Library's computers are located in a shared and public space and that a user's research may be visible to passersby or to neighboring computer users.  Because the library is a shared and public space and there is no part of the library that is not open to minors, patrons shall not use computers in the library to view materials considered to be obscene for persons under age 18 as defined by NJSA 2C:34-3 

2.4 Library staff is available to assist users with reference questions. Staff, however, is unable to give users extensive instruction in computer or Internet use or provide users with extensive aid in troubleshooting equipment or Web-related problems.


Rules of Conduct

3.1 Persons wishing to use one of the Library's computers must obtain a Library card.

3.2 Computers are available on a first-come, first-served basis.  An Internet computer session may be reserved by accessing the reservation software on the Library computer dedicated for this purpose.

3.3 West Orange library cardholders are entitled to computer sessions in one hour increments.  West Orange library card holders may extend their own sessions at their computer if there is no waiting list.

3.4 Persons who do not have West Orange Library cards may request and use a one-hour Visitor Pass.  When this time is expired no extension will be granted.  Users may request and use another one-hour Visitor Pass.  No extensions will be granted.

3.5 Printouts and disks may be purchased at the prevailing Library rate.

3.6 Misuse of Library computers may result in the termination of a user's access session or in suspension or loss of the privilege to use the Library's computers. Misuse includes, but is not limited to, using the computer for illegal activities; hacking into the Library computer system or any system; damaging or attempting to damage computer equipment or software; interfering with systems operations, integrity, or security;  gaining unauthorized access to another person's files or otherwise invading the privacy of another user; sending harassing messages to other users;  altering or attempting to alter the Library's computer settings; and violating copyright laws and software licensing agreements.

3.7 Users may not save data or programs on the hard drives of Library computers.

3.8 The Library is not responsible for damage done to users' disks, data, hardware, or software by any virus that may have been contracted on or through Library equipment. Although the Library has installed virus protection on its computers, it is impossible to protect against the appearance of a new virus.

3.9 The Library is not responsible for any damage done to computer users' disks, data, hardware, or software as a result of the malfunctioning of library hardware or software.

3.10 A user who has damaged, through inappropriate or unauthorized use, hardware or software owned or licensed by the Library will be liable for the cost incurred by the Library to repair the damage. If the damage is not repairable, the user will be liable for the cost incurred by the Library to replace the damaged hardware or software.

3.11 Users are asked to respect the privacy of other users. They may not seek access to another user's data or search history. They may not hover over a terminal being used by another. Persons invading the privacy of another user may be asked to leave the computer area; they also may lose computer privileges as set forth in paragraph 3.6 above.

3.12 The Library's computers are set up for the use of one person at a time. Parents or guardians, however, will be permitted to assist and supervise their children's use of the computers. Parents or guardians must supervise the use of the computers by children ages seven or under. 

3.13 The Library may, at its discretion, reserve computers for specific purposes. 

3.14 Children in grade six or under may not use the Internet computers in the Adult Department.

 

Special Rules of Conduct Applicable To Children's Room

4.1 Except as otherwise set forth in paragraphs 4.2, all the rules, regulations, and policies set forth above apply with equal force to the use and operation of the Children's Room computers.

4.2 Only children in grade six or under may use the Children's Room computers. Parents or guardians may assist or supervise their children's use of the Children's Room computers, but may not use one of the Children's Room computers to conduct research of their own.

 


Room Reservation Policies

Community Room, Meeting Rooms and Study Rooms:

The West Orange Public Library has various rooms available for various purposes, ranging from large public programs/lectures/meeting/presentations, to mid-size instruction, small meetings, and individualized study.


Rooms:

  • Community Room: capacity 285.  It is normally subdivided into two rooms with capacities of 141 and 145.  There is a fee of $150 to take the walls down for a 285 capacity event.  There is a $150 deposit required for cleaning and repairs.  Deposit will be returned if there is no cleaning or repairs required.
  • Quiet Study Rooms: Four rooms with a capacity of four each.
  • Two meeting rooms: capacity of each. 
     
    1. Meeting room 1: capacity of 12
    2. Meeting room 2: capacity of 8

 

General Room Policies:

Library behavior guidelines https://www.wopl.org/behavior-guidelines apply to all meeting rooms unless otherwise indicated in the specific room policies.

Meeting rooms are not available for the following activities:

(a) social gatherings, including, but not limited to, birthday parties, weddings, and receptions;

(b) commercial activities and presentations during which products or services will be sold or promoted or names solicited for the future sale or promotion of products or services;

(c) activities that, on account of their noise level, disrupt the ordinary and customary operation of the Library, including, but not limited to, athletic competitions or instruction, and programs involving dancing and live music;

(d) wagering, gambling, or other games of chance.

 

Quiet Study and Meeting Room Access Policy:

  • Quiet Study and Meeting Room reservations are available to West Orange Library Card holders, West Orange Library organizations, West Orange Municipal departments and committees only.
  • Quiet Study rooms may only be reserved by individuals 14 and older.  Under 14 must have someone 18 or older responsible and in the room.
  • Rooms are only available for reservation by individuals aged 18 and over.
  • Rooms may be reserved no more than 1 week in advance for no more than a 2 hour block. Requestor can stay longer than the 2 hour block if there is no reservation by someone else, or a walk-in request has not been made. At that time, the user must vacate the room as quickly as possible for the next user.
  • Reservations may be made by calling 973-736-0198, emailing roomreservation@westorangelibrary.org, or in person inquire at the circulation desk.
  • Walk in requests are available if they do not conflict with prior reservations.
  • Reservations will be invalidated should the party who reserved the room not arrive within 15 minutes of the reservation start time, unless prior notice is given. The room will be made available for anyone else to reserve or for a walk-in after 15 minutes.
  • No more than 1 request per day will be considered.
  • Chairs and tables will not be moved in or out of the quiet study and meeting rooms.
  • The library is not responsible for loss or damage of equipment, supplies, materials or any personal property owned by those reserving or using group study rooms at the library. 

 

Community Room Access Policy

 1.1 In the interest of advancing its mission of making available to the West Orange community the broadest range of material concerning matters of educational, recreational, and cultural interest, the West Orange Public Library (the "Library"), subject to the conditions set forth below, offers free, open, and equal access to its community room.


1.2 In scheduling use of the community room, the Library gives first priority to the Library programs, followed by other West Orange municipal programs. When the meeting room is not needed for Library or West Orange municipal programs, the Library gives priority to programs sponsored by West Orange organizations. The Library will attempt to accommodate organizations from outside the West Orange community when no schedule conflicts exist.


1.3 The community room is available only during regular Library hours. To ensure that the community room is available on as widespread and equitable a basis as possible, no organization may use the community room more than twice during any single calendar year. Meetings may not start until fifteen minutes after the Library opens and must conclude at least fifteen minutes before the Library closes. The Library does not set up or clean up the meeting room. Organizations using the meeting room must set up and clean up the room within the time period reserved.


1.4 Some patrons may consider programs held by outside organizations offensive to themselves or inappropriate for their children. The Library does not endorse the views expressed by any organization using the community room, but does endorse the right of all users of the community room to express their views so long as they comply with applicable federal, state, and local laws and regulations and abide by and carry out the rules, restrictions, and obligations of this policy.


1.5 Parents and guardians are responsible for determining whether their children attend particular programs. The Library does not act in loco parentis; it does not monitor the activities and decisions of minors.

 

Application Procedure

2.1 Any organization wishing to reserve the community room must file a completed application and completed use agreement with the Administration Office at least two weeks prior to, but not more than three months in advance of, the intended date of use. The application and use agreement forms are available at the Administration Office. The organization must also furnish a refundable security deposit of $150 at the time of filing the application and use agreement. Any check provided by the organization must be signed by an individual authorized to sign checks on behalf of the organization.


2.2 The individual signing the application and the use agreement must be over 18 and must be an authorized representative of the organization that wishes to reserve the community room.


2.3 The Library Director will grant applications to use the community room on a first-come, first-served basis and in accordance with the priorities established in paragraph 1.2 above. The Director will deny applications to use the community room when the applicant's proposed program involves an activity that is not permitted in the community room under General Room Policies or when the applicant's proposed program otherwise conflicts with the rules and restrictions set forth in this policy. The Director will also deny applications to use the meeting room during the period when the applicant's privilege to use the room has been suspended under paragraph 3.15.


2.4 The Director, or in the Director's absence, the Person-in-Charge, will act upon completed applications within five business days of their filing. The Library will immediately notify the applicant of the Director's determination.


2.5 The Library reserves the right to revoke permission to use the community room for good cause shown, including, but not limited to, failure to comply with any applicable federal, state, and local law or regulation, failure to abide by and carry out the rules, restrictions, and obligations of this policy, or disruption to the ordinary and customary operation of the Library.

 

Rules of Conduct

3.1 Organizations using the community room may not charge or solicit an admission fee, nor may organizations solicit membership fees or donations. Organizations may, however, request participants to reimburse the organization for the cost of supplies that are disseminated to participants and that are reasonably necessary for use in connection with the program being sponsored.


3.2  The maximum capacity of the community room is 285.  The normal configuration is two rooms with maximum capacities of 141 and 145. A refundable deposit of $150 is required for any configuration.  There is a fee of $150 to move walls for a 285 capacity event.  


3.3 At least one individual over eighteen for each ten minors participating in the program must be in attendance at the meeting at all times.


3.4 An organization using the community room may serve light refreshments and nonalcoholic beverages.


3.5 No smoking or use of open flames or candles is permitted in the community room.


3.6 The program being held cannot differ from the program described on the sponsoring organization's application without prior approval by the Director.


3.7 The Library will not advertise any program sponsored by an outside organization. All publicity must clearly identify the name of the sponsoring organization and provide the name and telephone number of an individual whom interested parties can contact with questions about the program or about Americans with Disabilities Act compliance. Publicity must also contain in clear and conspicuous language the following notation: "This program is not sponsored nor endorsed by the West Orange Public Library." The sponsoring organization may not post signs or other materials in the Library without prior approval by the Director.


3.8 Organizations using the community room are responsible for leaving it clean and returning it to the condition in which it was found. Chairs and tables must be returned to their original arrangement. Garbage must be bagged and sealed and food and beverages removed. The sponsoring organization assumes sole responsibility for any injury incurred in setting up or in replacing tables and chairs.


3.9 Fees: The Library collects a security deposit of $150 to secure itself against damage done to the meeting room or its furnishings during the course of the meeting, against theft of Library property during the course of the meeting, and against the failure of the organization to properly clean the room at the conclusion of the meeting. The refundable security deposit of $150 may be held in whole or in part by the Library to reimburse the Library for its cost of cleaning, repairing, or replacing Library property damaged, stolen, or not properly reassembled and cleaned as described above; the Library will refund to the sponsoring organization the amount of the deposit not required for this purpose within one month after the meeting date. To the extent the cost incurred by the Library for cleaning, repairing or replacing Library property exceeds the amount of the sponsoring organization's security deposit, the sponsoring organization is responsible for reimbursing the Library for the difference between the actual cost to the Library for cleaning, repairing, or replacing Library property and the security deposit. In the event the Library is unable to collect this amount from the sponsoring organization, then the individual signing the application and the use agreement on behalf of the sponsoring organization is responsible for its payment. The library charges $150 to move the walls to make an event 285 capacity. The walls will only be moved by trained library staff.


3.10 A representative of the sponsoring organization must report to the Person-in-Charge of the Library at the time of arrival and must notify the Person-in-Charge when the meeting has concluded and the meeting room has been cleaned and returned to the condition in which it was found.


3.11 A sponsoring organization that wishes to show a film, video, or audio presentation must provide its own operator. The volume level of the presentation must be approved by the Person-in-Charge prior to the commencement of the film, video, or audio presentation.


3.12 The Library and its staff do not undertake responsibility for providing security in the community room during the meeting. The sponsoring organization assumes responsibility for summoning police or other emergency personnel when circumstances require.  Library staff will call police or other emergency personnel as the circumstances require.


3.13 The policies and rules set forth above are inapplicable to Library or other government-sponsored programs and meetings or to programs sponsored by the West Orange Public Library Foundation Fund.


3.14 The failure of the sponsoring organization or of any of its members, or of any person under the control of the sponsoring organization or of any of its members to comply with applicable federal, state, and local laws, or with the rules and restrictions of this policy, or to fulfill any of the obligations set forth in this policy may result in the cancellation of the organization's reservation to use the community room or in the suspension of the organization's privilege to use the community room for a period of up to two years.


3.15 The sponsoring organization and such of its members as may be held accountable under law assume sole responsibility for injury to the person or property of any participant in the meeting caused by any of the sponsoring organization's members or by any other person under the control of the sponsoring organization or of any of its members.


3.16 Suggested Donations.  The library requests donations to help keep the room technology up to date.

            Community Room: $150 for 141 or 145 capacity, $200 for 285 capacity

            Meeting Rooms: $35

            Quiet Study: N/A

 


Registration Policy

Adult Cards:

  • Any person eighteen years and older who lives or owns property in West Orange is entitled to an adult card in the West Orange Library. These cards are valid for five years, after which renewal is required.
  • Students in grades 7 or higher who live in West Orange or whose parent or legal guardian lives or owns property in West Orange is entitled to an adult card in the West Orange Library. These cards are valid for three (3) years, after which renewal is required.
  • Individuals are required to show current, valid proof of West Orange residency or property ownership at registration.
  • Each card is an individual card, not a family card.


Youth Cards:

  • These cards are issued to youth through the sixth grade.
  • A parent or legal guardian must sign the card registration.
  • A child through the 6th grade who is issued a library card must be present with the parent or legal guardian at the time of registration. The parent or legal/guardian will be required to present a valid birth certificate for the child or documentation that establishes legal guardianship.
  • A Parent or legal guardian is required to show current, valid proof of West Orange residency or property ownership at registration.
  • The holder of a youth card has the same access to materials and services as the holder of an adult card.
  • These cards are valid for three (3) years, after which renewal is required. Individuals are required to show current, valid proof of West Orange residency or property ownership at renewal.
  • The holder of a youth card must re-register when he/she is in seventh grade.
  • Each card is an individual card, not a family card.


Courtesy Cards:

  • Non-residents who work or attend school in West Orange are eligible for a free courtesy card, adult or youth, depending on age.
  • Individuals are required to show current personal identification and valid proof of employment or attendance at a school in West Orange at registration.
  • Each card is an individual card, not a family card.
  • Non-resident courtesy cards are valid for 12 months, after which renewal is necessary. Valid identification, described in 2, is required at renewal.
  • Courtesy cards are valid for use with all materials and services except certain programming which is restricted to West Orange residents.


Out-of-Town Membership:

  • Membership not covered by the above statements may be purchased upon payment of an annual fee of $100.00 per person. The West Orange Library Board of Trustees sets the fee annually.
  • Individuals are required to show valid personal identification, which includes an address.
  • This is an individual card, not a family card.
  • Out-of-Town cards are valid for use with all materials and services except certain programming which is restricted to West Orange residents.


Reciprocal Borrowing Libraries of Essex County (ReBL) - Issuance to West Orange residents:

  • Any person who lives or owns property in West Orange may be entitled to ReBL borrowing privileges. These borrowing privileges are valid for the calendar year, after which renewal is required.
  • Patrons must be in good standing in order to obtain ReBL borrowing privileges.
  • Each participating library sets the policy for materials they will lend to ReBL borrowers.


Reciprocal Borrowing Libraries of Essex County (ReBL) - Activating West Orange borrowing privileges to non-residents:

  • Patron must present a current library card from one of the participating Essex County ReBL libraries.
  • Patron must present valid identification which includes their complete address.
  • This is an individual card, not a family card.
  • Non-resident ReBL borrowers may have borrowing privileges for all materials except new DVDs. ReBL borrowers may not place reserves or interlibrary loan requests. ReBL borrowers may not participate in programs which are restricted to West Orange residents.


Registration Renewal:

1. All individuals in all membership categories must show current personal identification and, where applicable, either proof of residency, property ownership, school attendance or proof of employment in West Orange.

2. All accounts must be paid in full at renewal.


Suspension of Library Membership:

1. Any membership may be suspended if, in the judgment of the Library Director or their designee, the privilege has been abused.

2. Among grounds for suspension are vandalism, theft of library property, creating a disturbance, or other violations of law or property.

3. The Library will suspend the borrowing privileges of a patron who owes the Library fifty dollars in fees, fines, and other charges. The Library will restore borrowing privileges only after the patron has settled the account in full.

*Materials owned by other libraries may have different fine policies. Most 28-day books, magazines, audiobooks and CDs may be renewed twice. New books may be renewed once. Items reserved by another patron and movies may not be renewed.

All due dates for materials checked out of the library are provided on a printed slip at the time of checkout. Patrons may also check their online record or call the library at any time to verify due dates. Failure to receive courtesy or overdue notices does not relieve you of your obligation to pay any accrued.


Collection Costs

1. Notice: A notice is sent to the patron when the item is approximately 14 days past due. A second notice is sent to patrons when an item is 28 days past due.

2. Billing and Referral to Collection Agency: Approximately 60 days after an item is past due, the Library will bill the patron for the replacement cost of the item. If the amount owed by the patron exceeds $100, the Library will refer the account to a collection agency and the patron will be responsible for all charges connected with collection.


Calculation of Replacement Cost of Lost or Damaged Materials

A. Lost Items:

1. The patron will be responsible for the replacement cost of all lost items. The patron may provide an exact copy of the item-in new condition-as a replacement for a West Orange lost item.

2. If the item is no longer available, the Library will charge as its replacement cost the default amount determined by the BCCLS Policies and Procedures Committee.

3. The replacement cost of a lost issue of a magazine is the current charge for an issue of the magazine.

4. If a patron pays for a lost item and subsequently finds it, the Library will issue a refund only if the patron returns the item to the Library within 1 month of the date when the item was billed. If the patron has chosen to provide a replacement copy of the lost item, the Library will not issue a refund.


Damaged Items

The Library will charge the patron the replacement cost, as defined above, of any item which the Library, in its sole discretion, determines has been damaged.


Suspension of Borrowing Privileges

In addition to the fees and charges set forth above, the Library will suspend the borrowing privileges of any patron who owes the Library more than $10 dollars in fees, and other charges.  The Library will also suspend a patron’s reciprocal borrowing (ReBL) privileges at the same time. The Library will restore borrowing privileges only after the patron has settled the account in full.  In the event a check presented for payment is returned, a returned check fee of $20 will be added to the patron's account, and borrowing privileges will be suspended until payment is made in full.


Interlibrary Loans and Reciprocal Borrowing

A patron borrowing an item from another library by way of interlibrary loan will be responsible for the fees, fines, and charges set forth above as well as any fees, fines, and charges assessed by the originating library.

A patron borrowing an item from the Library through the REBL program will be responsible for the fees, fines, and charges set forth above. In addition, the Library will send a bill for all lost items to the patron’s home library.

Replacement Library Cards

There is a $3.00 charge for a replacement library card.


Nonresident Membership

The fee for a nonresident membership is $100 a year. A nonresident membership card is an individual card, not a family membership.

Additionally, a three-month nonresident membership card may be purchased for $30. Reciprocal borrowing privileges are not available with a three-month card.


Photocopying and Printing

Self-service printing and photocopying are available. There is a fee of 15 cents /page for b&w photocopies or b&w computer printouts; there is a fee of $1/page for color photocopies or color computer printouts; there is a fee of 10 cents /page for microform copies; there is a fee of $8 for flash drives.

The Library will not accept personal checks for amounts under $10. Credit cards may be used to pay fines (with a $1 fee per transaction). Patrons may also pay through their online library account.

 


Security Camera Policy  

Purpose  

West Orange Public Library strives to take reasonable precautions to assure a safe and secure environment for its patrons and staff. Because library staff are unable to provide direct supervision over all areas within the library and library grounds, video security cameras have been placed at selected locations in order to observe and record visible activities of persons within the library and library grounds in lieu of direct supervision.  

Observation of activity, whether in real time or from digitally recorded storage, shall be limited to activities that are specific to library operations, may affect the safety and security of library patrons and staff, and provide protection for library assets or property. Real-time monitors may be set up in public areas at the discretion of the director.  


Privacy and Confidentiality  

Camera placement shall be determined by the library director or his/her designee. Cameras shall not be placed in areas where there is a reasonable expectation of privacy, such as restrooms.  To the extent that any recorded images include identifiable persons requesting information or checking out an item, such record shall be treated as confidential as provided in NJSA 18A:73-43.2. Only designated library staff may view real-time images or screen-recorded images for potential breach of confidentiality. Any inadvertent views of protected information shall be held in confidence by the library staff under the library’s confidentiality policy.  


Public Notice  

Signage shall be conspicuously displayed within the library advising of the recording of video images. Conversations or other audible communication shall not be monitored or recorded by the security cameras.  


Data Storage  

Cameras will record activities in real time, and images will be saved to the camera server’s hard drive. The capacity of the storage system allows for images to be stored for at least 14 days. Current software deletes images automatically as the capacity of the hard drive is reached. The library is not obligated to store images past the 14-day limit.  

Cameras will not be monitored continuously by library staff. Authorization to view stored images may be granted by the library director or his/her designee(s).  Authority to 


Access Recorded Data  

The Director holds the authority to designate library staff members who may access video in real time or in recorded formats. Generally, authority may be delegated to the senior computer service technician, supervisory staff, or public service desk staff, including librarian and librarian assistant staff during hours of operation.  

Circumstances under which designated staff may access images in real time include, but are not limited to, observation of areas beyond view from designated work stations for assurance of safety and security. 

 


Unattended Children Policy

The public library is a place where any person may come to read, relax, work, look for books and other information, etc. It is a place where people of all ages are welcome. Children, as well as adults, should feel they are welcome at any time. The library should not be a threatening place for a child; therefore, the following policy has been established.

Children seven (7) years of age and younger may not be left unattended in the Library.

Children between the ages of eight (8) and ten (10) may be left alone in the Library for no longer than 30 minutes until 5:00 pm.

No child up to the age of ten (10) may be left in the Library unattended after 5:00 pm.

A parent or other adult responsible for a child must supervise that child while in the Library.

If a child is left unattended at the time the Library is closing, whether it is our regular closing time or for a snow emergency or some other unforeseen reason, the Police Department will be notified, and the child will be picked up by a Police person. The child will be taken to the Police Station to await pick-up. We will try to notify parents by telephone, but if this is not possible, a note will be left on the Library’s doors, indicating where the child is.

 


OPMA

IMPORTANT CHANGES TO OPMA LEGAL NOTICE RULES

In response to issues created by the closure of many local newspapers, and discontinuation of the print editions of others, the New Jersey Legislature enacted changes where and how local government entities must publish or advertise all legal notices under the NJ Open Public Meetings Act (OPMA) and Local Public Contracts Law.

  • Starting March 1, 2026, all public entities in New Jersey, including public libraries, must publish all legal notices on their websites. This includes announcements of all public meetings of the organization, RFPs/RFQs, and awards of public contracts. The legal notices must be accessible via a clearly visible link on the home page to the website, which must be clearly labeled (e.g., "LEGAL NOTICES"), and must be freely accessible with no paywalls or logins required.
  • Each notice must remain on the website for a minimum of seven (7) consecutive calendar days (i.e., one week). All notices must contain a timestamp showing the original posting date. After the first week, the notice must be transferred to a searchable online archive on the website, and must remain accessible in the archive for at least one (1) year.
  • Between January 1 and March 1, 2026, public entities have the option to continue advertising in a newspaper or can simply post on their website (website makes more sense and you save the cost to advertise).
  • Throughout calendar year 2026, public entities must publish twice per month in an online news publication an ad stating where their legal notices can be obtained on the public entity's website, including a link to their website.
  • Between January 1 and March 1, 2026, public entities must send their website link to the Secretary of State for inclusion a new State-wide directory of website links.
